Our Fees.

Honest pricing. ARO 2014 compliant. No surprises.

We believe clients are entitled to understand how a law firm charges before they instruct it. All of our fees comply with or exceed the minimum fees prescribed by the Advocates (Remuneration) Order, 2014, made under section 44 of the Advocates Act (Cap. 16). We treat that Order as our floor, not our ceiling. We never price below it.

How we price our work.

We use four approaches depending on the type of work. The right approach is matched to your matter at the engagement stage.

Fixed-fee productized services

For straightforward, well-defined services we charge a fixed fee that you know in advance. These include commissioning of affidavits, certification of documents, business and company registration, single-class trademark filings, demand letter sequences, basic agreement drafting, and similar work. The fixed fee is transparent and not subject to surprise revisions.

Scale fees for property, probate, and certain litigation

For conveyancing, probate, and certain litigation work, the Advocates (Remuneration) Order, 2014 prescribes scale fees as a percentage of transaction value with stated minimums. We apply the scale rates directly. For a property sale of KES 10 million, the scale fee is 2% (KES 200,000) or our firm minimum, whichever is higher.

Hourly billing for complex advisory and litigation

For complex advisory matters, constitutional litigation, anti-corruption defence, cross-border financial advisory, and regulatory work, we bill by the hour. Our hourly rates reflect the seniority of the fee earner doing the work. We discuss the estimate with you before we begin, send monthly bills with detail of time spent, and tell you promptly if the matter is heading above budget.

Value-billed and outcome-linked work

Where a matter has a clear measurable outcome, we can structure the fee as a base engagement fee plus a success element, in compliance with paragraph 41 of the Advocates (Remuneration) Order, 2014. We never agree to be paid solely on outcome. The engagement fee is paid regardless; the success element is a defined bonus, calculated transparently, and disclosed in writing.

For services not listed, please contact us for a quotation tailored to your matter. All prices are exclusive of VAT (16%), disbursements, and government fees. These items are billed at cost without mark-up.

What our fees do not include.

Our quoted fees are professional fees only. They are exclusive of:

  • Value Added Tax at the applicable statutory rate (currently 16%).
  • Court filing fees, KIPI official fees, lands registry fees, stamp duty, courier and process serving costs, and other disbursements paid to third parties on your behalf.
  • Government and regulator fees of any description.

These items are billed separately at cost. We do not mark them up. Substantial disbursements are normally paid by the client upfront or transferred to our client account before we incur the expense.

Payment and invoicing.

We accept payment by:

  • M-Pesa Paybill: 522533 — Account Number: 7942516
  • Bank transfer: Account details provided in your Letter of Engagement
  • Cheque: Payable to Clay & Associates Advocates

As a general rule, 50% of the agreed fee is payable on signing the Letter of Engagement and before work commences; the balance is payable on completion or at the agreed milestone.

We issue tax-compliant invoices through the Kenya Revenue Authority's electronic Tax Invoice Management System (eTIMS) as a matter of course. There is no surcharge for receiving an ETR-compliant invoice; this is how we invoice all our work.

We welcome conversations about fees. If you want an indicative quotation before formally instructing us, please contact us with a short description of your matter and we will respond with an indicative fee range and the engagement structure that applies. Where a matter has unusual features or scope ambiguity, we may suggest an initial consultation to scope the work properly before agreeing a fee.

Our Schedule of Fees is reviewed annually each January and updated whenever a replacement Advocates (Remuneration) Order is gazetted by the Cabinet Secretary responsible for justice. Material changes are notified to existing clients in writing.
